Troca de e-livros legal ou ilegal?
Os eBooks são livros eletrônicos que você pode comprar on-line e também vender ou trocar em determinadas páginas. Se este último é realmente legal é atualmente controverso:
- Aqui há diferenças entre livros normais e eBooks. Com o último, você não adquire propriedade com a compra, mas apenas um direito ilimitado de uso. Você pode ler o texto, mas não é seu. Portanto, você não deve usá-lo à vontade.
- Desde que você tenha apenas esse direito de uso, cabe ao respectivo provedor se você pode trocar o livro legalmente ou não. Isso geralmente é regulado nos termos e condições.
- Outro problema é evidente nas próprias trocas de bolsa: o eBook não é reconhecível como o original aqui. Isso permitiria que os fraudadores pirateassem o arquivo eBook e o vendessem ou oferecessem para troca. Se você comprar um e-book, não terá direito legal de propriedade nem direito de uso. Em outras palavras, você não seria o proprietário legal do livro.
- O respectivo provedor de e-book pode até proibir vendas entre amigos em seus termos e condições. O BGH também confirmou isso em seu último julgamento (BGH AZ: I-ZR 120/14, OLG Hamm AZ: 22 U 60/13). Essa decisão também pode ser transferida para a troca com eBooks. No entanto, não há jurisprudência clara sobre esse assunto.
- No entanto, empresas como a Sony estão atualmente trabalhando em proteção especial contra cópia para eBooks. Esses livros protegidos podem ser marcados especialmente para que você possa vendê-los e trocá-los em trocas. Mas isso também depende do provedor.
- Até lá, você não deve trocar ou vender seus eBooks por razões de segurança.
